Legal and Privacy Policy Terms

These Terms apply to every online or mobile site, service, system or resource (the “Services”) belonging to OneMe Tech LLC ("OneMe," which includes its successors and assigns). 

“You” and “your” refer to any person who accesses or uses the Services, including that person’s agent or guardian.

By using or accessing the Services, you agree to these Legal and Privacy Policy Terms (“Terms”).

The Services are in beta (experimental) version. These Terms reflect risk and compliance decisions by OneMe and its professionals that are balanced and proportionate to the circumstances.

These Terms govern your use or or access to the Services, including any content, functionality and service offered on or through the Services and any data you store,access, share or validate through the Services.  

OneMe may change these Terms at any time. These Terms and any change to these Terms are effective upon posting. By continuing to use or access the Services after the time of posting, you agree to be bound by the most recent version of these Terms. 

1. Ethos of Blockchain Validation

Through the Services, OneMe seeks to enable you the user to pursue an ethos of blockchain validation for storing, fingerprinting, authenticating, timestamping, cataloging and influencing access to data. The ethos seeks to vest in the user dominance over data storage and sharing. You decide if you want to store, validate, or modify data. 

OneMe pursues and implements the ethos as OneMe interprets it in its sole and absolute discretion.

Within the Services, any user-stored data not validated by the blockchain is of dubious value or meaning. Unauthorized access to such data is undermined because it normally does not benefit from data validation by the blockchain.

OneMe provides the Services at no charge to you.

2. Unauthorized Activities

In regard to the Services, you will engage in only appropriate use, access and conduct. By way of example, you will not do any of the following:

• use the Services in any way that violates law, 

• attempt to hack or eavesdrop in the Services, or exceed authority within the Services,

• cause an unreasonable or disproportionately large processing load on the Services or the systems that support them, 

• restrict or inhibit use of the Services by others, 

• introduce or transmit any virus, worm, Trojan or other material that may harm or disrupt the Services or the systems that support them, or

• store or communicate offensive or objectionable material. 

Unauthorized use or access of the Services is strictly prohibited.

You will not access the Services to test, scan, probe, inspect or investigate OneMe, its vendors or owners, or the Services or the systems that support them, without explicit, written permission of OneMe. 

If while violating this Section 2, you copy or gather any information or evidence, you must not use it, you must not disclose any of it to anyone other than OneMe and you must destroy all copies and records of it immediately.

3. Monitoring of Unauthorized Use or Access

OneMe may track, monitor, investigate and collect data about any use or access of the Services that appears unauthorized. OneMe may use or share such data, consistent with law.

4. Backup and Termination

You are responsible for maintaining a backup copy of any data you store through the Services. Stored data might become lost, destroyed or inaccessible.

OneMe may modify or terminate the Services or terminate your access to the Services at any time. Modification or termination shall not terminate the other relevant provisions of these Terms.

5. Trademarks, Copyrights, and Restrictions on Use

The format, appearance and expressions of the Services are copyrighted © by OneMe, its vendors or third parties.  All rights are reserved.

The format, appearance, concept, functionality and expressions of the Services are proprietary, intellectual property to OneMe, its vendors or third parties. You agree not to copy or reuse them, and you agree not to help others do those things.

All trademarks, service marks, trade names, trade dress and other intellectual property in the Services are proprietary to OneMe or their respective owners. 

OneMe gives you limited, non-exclusive, non-transferable permission to use the Services, but only in accordance with these Terms. Permission to use the Services does not imply any greater rights or license to intellectual property. 

All rights, title, and interest in and to the Services, including any software, documentation, and corresponding intellectual property, shall remain the property of OneMe or its vendors, or are publicly available. All rights not expressly granted under these Terms are reserved by OneMe, its vendors, or third parties.

You will not copy, display, distribute, transmit, transfer, link to, frame, alter, decompile, reverse engineer or create derivative works of, any intellectual property in the Services except as is consistent with your bona fide use of the Services as a user. 

6. Claims of Infringement, Other Violation of Law or Legal Demands

If you believe the Services infringe intellectual property, violate law, or give rise to a right for you to make a legal claim or demand, please send OneMe notice of this belief to info@oneme.app . Please explain your belief in detail.

7. Products or Services by Others

The Services may link to or draw upon products or services offered or controlled by vendors or other third parties. OneMe does not endorse and disclaims all liability for such products or services, including security or privacy practices. Any products or services provided by a third party are those of the third party and not of OneMe. 

8. Cookies and Transfer of Data

OneMe and its vendors may use cookies and similar technology to collect and analyze information about the users of the Services to ensure the Services function as intended. You consent to the use of cookies and similar technology.

9. Disclaimers and Limitations of Liability

Due to the possibility of error and other factors, the Services (including all content, software, functionality, and materials), are offered by OneMe on an "as is," “as available” basis, with no warranty of any kind—whether express, implied, or statutory—including, but not limited to, warranties of title, non-infringement, merchantability or fitness for a particular purpose. 

Neither OneMe nor anyone else warrants that the Services will be continued, uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of the Services, or as to the content, timeliness, sequence, accuracy, reliability or completeness provided through the Services.

Perfect security does not exist.

To the maximum extent permitted under applicable law, in no event shall OneMe be responsible for any loss of any kind related to the Services, including loss associated with defect in the Services or malicious software which may infect your technology. 

To the maximum extent permitted under applicable law, in no event shall OneMe be responsible to you or anyone else for any direct, indirect, special, consequential, incidental, punitive, exemplary, lost profits, economic or other damages related to the Services, regardless of the form of action, whether in contract, warranty, tort (including negligence), strict liability, or otherwise.

Nothing herein shall be construed to limit or reduce OneMe’s non-negotiable obligations and responsibilities to users under applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless OneMe and its owners,  officers, employees, agents and vendors from and against all losses, liabilities, damages, claims and expenses, including attorneys' fees, arising out of, relating to, or resulting from your violation of these Terms or misuse of the Services. 

11. Not for Children

The Services are intended for individuals who are at least 13 years old. If you are under the age of 13, please do not access these Services. A parent or guardian may access the Services to support the data of an individual under 13.

12. Disclaimer of Offer

OneMe does not offer products, services or information where prohibited by law.

13. Account Deletion

You may also request deletion of your account from our databases in order to close your account and prevent receipt of future communications. When you choose to delete your account, all of your personal information associated with the account will be deleted and is no longer accessible by you or OneMe.

14. Miscellaneous

These Terms are governed by the laws of the State of Texas, with the exception of its conflicts of laws provisions. 

You and OneMe agree, to the maximum extent permitted by applicable law, to submit to the personal and exclusive jurisdiction of the state and federal courts located within Texas and to venue in Texas.

You must give OneMe notice of any claim or cause of action (a “Claim”) arising out of or related to use of the Services within one (1) year after you became aware of the material facts and circumstances giving rise to such Claim. Any Claim must be filed within two (2) years after such Claim arose, or be forever barred. 

If any term or provision of these Terms is unenforceable, the remaining terms and provisions shall be unimpaired and the unenforceable term or provision shall be replaced by such enforceable term or provision as comes closest to the intention underlying the unenforceable term or provision.

These Terms set forth the entire agreement between the parties concerning the subject matter herein. They supersede and merge all prior agreements, representations, warranties, promises, and understandings on such subject matter.

OneMe may assign its rights and responsibilities under these Terms.

Each vendor to, and officer, owner, employee, agent of, OneMe is a third-party beneficiary of these Terms and is entitled to rely on the agreements, disclaimers and limitations of liability in these Terms.
